A statutory declaration is a legal statement made by one person in the presence of a lawyer, solicitor or notary public. This statement of fact is recorded in a written document and signed by both the person making the statement and the solicitor or notary witnessing the process. They are very similar to affidavits and the two terms are often used by overseas authorities requesting you make a sworn statement. You will often here them referred to as a ‘stat dec’.

FAQs

When the solicitor or notary public signs the document, they must:

  • have a valid practising certificate
  • sign the document in the UK
  • state the action they have taken eg witnessed, certified a copy, confirmed as original
  • use their personal signature, not a company signature
  • include the date of certification
  • include their name and company address

The signature should also be an original ink signature. Digital or copy signatures are not suitable.

You will find many templates online, both free and to purchase for a small fee. Most Solicitors and Notaries can prepare one for you, but will charge a fee for their services.
